Precedent – Whistleblower Bounty
In late 2010, GlaxoSmithKline (GSK) agreed to a $750m settlement with US authorities triggered by manufacturing failures at its plant in Puerto Rico, in relation to the production and sale of “adulterated” drugs. The sum included civil and criminal penalties, with $96m paid to Cheryl Eckard, a former quality assurance manager at GSK who alerted authorities to manufacturing abuses. Ms Eckard first warned of a series of violations which when raised with GSK resulted in her being dismissed in 2003.

The Dodd-Frank Wall Street Reform and Consumer Protection Act of 2010 provides financial incentives for employees to inform regulators of securities fraud and other wrongdoing.

The U.S. Securities and Exchange Commission Whistleblower Bounty rules may increase costs for corporations and undermine internal fraud detection efforts launched under the 2002 Sarbanes-Oxley Act.

zEthics strikes a unique balance between employees, corporations and regulators - providing employees protections against retaliation and discrimination by employers; allowing employees to retain their status as providers of original information; while permitting the employer to investigate and self-report to regulators as necessary.
